Option #1 : Your email must be backed up and restored to new location.

#2 Use a mailer like Thunderbird to get messages and save to local system then you can import back to server or just keep on the local system in TB.
If you can't trust this dude then download all messages immediately and delete from server and relocate domain ASAP. Thunderbird has receive messages and delete from server location options.
Don't keep messages on server, he can use these against you.
If you already changed domain DNS then you can still get the mail from the old IP address from where ever he hosted from: You can get this from A record if you haven't transferred domain yet:
